Pre-Marital Agreements

Greg Gegenheimer has more than 34 years experience in drafting pre-marital and partition agreements. A pre-marital agreement is an enforceable contract between a man and woman intending to marry. It defines how they will handle their financial affairs. A married couple may choose to divide their community property into separate property after the marriage. This is known as a partition agreement, and can divide what was once the community property of the parties into separate property, or change the character of income.

In most marriages, there are three estates. The husband's separate estate, the wife's separate estate, and the community estate. Earnings during a marriage are generally part of the community estate. Couples intending to marry, or married couples, may enter into agreements that will characterize with great specificity what property is to be separate and what property is to be community. The agreement may also provide whether earnings will be separate or community.These agreements permit parties to have great flexibility in deciding precisely how they wish to arrange their finances and have confidence that the agreement will be enforceable.

Premarital agreements are not enforceable regarding custody of children or child support.
