Sometimes things change after a Final Decree of Divorce or other Order concerning children has been entered, that require the Decree or Order to be revisited and modified. A change in the income of the parent paying child support may justify an increase or decrease in the child support order. When a payor looses his job, his court ordered child support remains in full force and effect until he takes the initiative to change that Order. Changes can be made fairly quickly with a Temporary Order to adjust support until such time as the payor can return to normal employment. A delay in the decision to modify child support can seriously, adversely effect ones finances.
If the parent receiving child support believes the parent paying child suport has significantly increased his income since the child support order was entered, it is appropriate to modify that order to ensure your children are getting the support to which they are entitled. Delaying action to increase child support only reduces the total child support one receives.
